Mortgage Assumptions and Title Transfer

Our prior written consent is required before any mortgage may be assumed. If title is transferred without our prior written consent, the full amount outstanding on the mortgage may come due immediately. The purchaser(s) or transferee(s) may apply for approval to assume a mortgage at any CIBC branch. All applicants must attend in person to complete the application process.

REMINDER: This is a reminder to pay particular attention to sections 14 A & B in the Instructions to Solicitor. You are responsible to advise us of any irregularities.

Effective January 4, 2012 , the following document has been updated:

  • Instructions to Solicitor – (Schedule of Non-Interest Fees, Appendix A – Acceptable forms of Identification, Appendix B –“IVF” form (1010):
    • Changes made to the Schedule of Non-Interest Fees.
  • Please ensure that the revised Schedule of Non-Interest Fees is provided to all mortgagors and guarantors.

Please immediately discontinue use of any previous copies of this document that you may have printed or saved, as they are now obsolete.

Effective November 1, 2011 , the following documents have been updated:

  • Charge/Mortgage of Land – Land Titles Act (Form 7399)
    • Please complete Box 11 of the Charge/Mortgage of Land in accordance with the Mortgage Disclosure Statement (See “ Default Insurance” section).
  • Document Completion Instructions (5722)
  • (New Form) Mortgage Statement Request (Discharge or Transfer)
    • Please use this form when requesting mortgage discharge or transfer statements.

Effective August 19, 2011 , the following documents have been updated:

  • Instructions to Solicitor - (Schedule of Non-Interest Fees, Appendix A - Acceptable forms of Identification, Appendix B -"IVF" form)(1010):
    • Additional Form of Identification (Ontario Photo Card) has been added to Part “A - Acceptable forms of Identification”.
  • Document Completion Instructions – (Forms 5722)

Effective July 29, 2011 , the following documents have been updated:

    • The Fax numbers on page 1 for the Regional Mortgage Centres have been changed.
  • Solicitor’s Interim Report / Requisition for Funds (1053, all Provinces and Territories except ON, NU and QC)
